The Bailout feature is a voluntary, in-app personal safety tool available within the Invitrr Service. This Bailout Policy describes the nature, limitations, and conditions of the Bailout feature. This policy forms part of and is incorporated into our Terms of Service. By using the Bailout feature, you acknowledge that you have read, understood, and agree to the terms of this policy in their entirety.
Availability of the Bailout feature may vary by geographic location, device, operating system version, app version, and network connectivity. Invitrr makes no representation that the Bailout feature is or will remain available in any particular location or at any particular time.
When activated by a user, the Bailout feature may, depending on feature availability and technical conditions, perform some or all of the following actions:
The specific functionality performed upon any given Bailout activation depends on a variety of factors outside of Invitrr's control, including without limitation: the user's device, operating system, app version, network connectivity, location service settings, availability of volunteers in the user's vicinity, and reachability of designated emergency contacts. Invitrr does not guarantee that any specific functionality will be performed in any given instance of activation.
You acknowledge and agree that your use of the Bailout feature is at your sole risk. Invitrr and the Invitrr Parties shall not be liable for any harm, injury, loss, or damage of any kind arising out of or relating to your use of, failure to use, or inability to use the Bailout feature, or arising out of the action, inaction, or conduct of any volunteer or emergency contact in connection with a Bailout activation.
Invitrr volunteers are individual users of the Service who have voluntarily opted in to receive Bailout alerts and who have agreed to endeavor to provide assistance to users who activate the Bailout feature. Volunteers are independent individuals and are not employees, agents, contractors, or representatives of Invitrr. Invitrr does not employ, train, supervise, direct, or control volunteers, and makes no representation regarding the identity, qualifications, training, availability, suitability, or fitness of any volunteer.
Invitrr is not responsible or liable for any action, inaction, statement, or conduct of any volunteer in connection with the Bailout feature or otherwise. Volunteers participate on a voluntary basis and may decline to respond to or act upon any Bailout alert for any reason.
Bailout activation data, including timestamps and associated location data, may be stored in our systems and on your device in accordance with our Privacy Policy. This data may be retained for operational, safety, fraud prevention, and legal purposes. We may share Bailout-related data with law enforcement or other authorities where required by law or where we determine, in our sole discretion, that sharing is necessary to prevent harm. Bailout PINs, where applicable, are stored in encrypted local storage on your device and are not transmitted to Invitrr's servers.
Invitrr reserves the absolute right, in its sole discretion and at any time without notice, to modify, limit, suspend, or permanently discontinue the Bailout feature or any component thereof. We may change how the feature works, the conditions under which it is available, the geographic areas in which it operates, or the functionality it provides. We may also discontinue the Bailout feature entirely. Your continued use of the Service following any such modification constitutes your acceptance of the change. Invitrr shall not be liable for any harm arising from modifications to or discontinuation of the Bailout feature.
